Examples of mediation outcomes

Supercar crashed by former F1 driver

The dispute arose when the owner of an ultra precious supercar loaned it to a former F1 star who then crashed it during a race. The former F1 star blamed the car and the owner blamed the driver as out of practice and simply not competent to race any more. The owner believed that loan was on terms that driver would insure and driver believed that it was for the owner to do so; nothing in writing on the point. Finally and importantly, there was an ongoing business relationship involving marketing activities for the owner’s businesses.

Court or arbitration proceedings would have led to an unpredictable win/lose outcome – sudden death for the losing party. Instead, Mediation was agreed and the final settlement preserved the business relationship and, indeed, specified increased tasks to be carried out by the driver. In addition to achieving certainty and preserving the relationship, the mediation saved an estimated £250,000 in costs for each side (when comparing the costs of the mediation to the projected costs of going to court).

Collision of Yacht And Tanker Leads to Dispute About Upgrades

Multi-million dollar yacht was at anchor in the Caribbean when struck by a tanker and suffered major damage. The yacht was towed to a nearby repair yard & the owner took the opportunity to carry out considerable ‘own works’. There were difficult issues as to the cost (and time) of repairs attributable to the collision, betterment (whether the owner was seeking to upgrade the yacht at the colliding vessel’s expense) with some choice of law and jurisdictional issues thrown in.

A settlement was concluded at the end of a long day of negotiation. The projected costs of taking the matter to a full-scale Court hearing were in excess of £300,000 for each party whereas the costs per party at the conclusion of the mediation were less than £40,000.

Important relationship preserved for Shipowner and Charterer

Dispute between Claimant Shipowner (owners of a modern, well run fleet) and Defendant Oil Major charterer. In a sharply falling freight market, Charterers alleged vessel had arrived late and cancelled the charter party. Shipowners denied that the conditions entitling Charterer to cancel had been satisfied, re-fixed the vessel at the then lower market rate and claimed the differential of approx. USD 1.2 million from Charterer in London arbitration.

The outcome of the mediation was a new, long-term contract between Shipowner and Oil Major whereby the Oil Major gave the Shipowner first refusal for specified cargoes/voyages at specified rates. This is an outcome which no judge or arbitrator would have had the power to order and which was hugely more beneficial to the Shipowner than winning the original claim. Indeed, the original claim was simply “parked” in light of the new agreement reached.

The projected costs of taking the matter to a full-scale Court hearing were in excess of £300,000 for each party whereas the costs per party at the conclusion of the mediation were less than £40,000.

When he’s not at work…..
Jonathan is married with 3 grown-up children. One of his main passions is motor sport: he races Classic Formula Ford cars and has taken part in several endurance rallies; he has also participated in the 1997 Beijing to Paris Classic car rally. At a slower pace, he loves hill walking, especially in Scotland.
