Mark joined Eversheds (then Alexander Tatham) as a trainee in 1972, retiring in 2005. In that time, his achievements included:

  • Head of Eversheds North Construction and Engineering Team

"Throughout my career, my work has been exclusively contentious, covering mediation, litigation, arbitration, adjudication an other forms of dispute resolution.

"I therefore have many years of experience to bring to the table, able to judge each dispute on its own merits and adopt the best approach to help everyone communicate effectively.

 Examples of successful mediation cases

Mark has mediated disputes across various sectors. Examples include:

  • Banking- Multi-million pound claims agaisnt high street banks for mis selling  interest rate swaps
  • Shareholder/partnership- breach of fiducairy duty and unfair prejudice claims, many very high value
  • Construction/engineering - Four-party dispute between utility company, main contractor, subcontractor and engineer, arising out of inadvertent blocking of main sewer caused by sheet piling. Settled on the day of the mediation.
  • Professional negligence - Claim for damages against loss assessor and contractor arising out of failure to prevent asbestos contamination. Settled by payment of agreed figure split between paying parties.
  • Landlord/tenant - Dispute concerning the right of a landlord to recover substantial costs incurred in carrying out work to the building. A significant issue was whether the works should be claimed as "repairs" or "improvements", the latter being irrecoverable. Settlement achieved within the day.
  • Boundary/right of way - Multi-party right of way dispute. Settled on the basis of an agreed plan and specification for an ungraded road.
  • Company/shareholder/partnership - Dispute between two firms of solicitors arising from a partner transferring from one firm to the other. Settled before lunch.
