Graham Howard General Information Graham is a commercial, intellectual property and technology law counsel with over 25 years experience in industry, academia and private practice, both at the Bar in England and as a commercial solicitor and in-house counsel in New Zealand, Australia and the Middle East. Graham accepts instructions in a wide variety of business related disputes and has broad and deep experience in commercial litigation and contractual review and drafting including technology licensing, franchising, agency and distribution agreements and related disputes plus trans-jurisdictional participations and joint ventures. Other areas include internet disputes and e-commerce, passing off disputes, patent and design litigation, trade secrecy (including employee/employer issues), IP rights enforcement and commercialisation in many technology scenarios including hard and soft intellectual property rights and copyright disputes in a variety of media. Graham attends Court as counsel in varied White Book civil and commercial litigation cases including the broad range of interlocutory applications and some judicial review and also conducts commercial and civil mediations and arbitrations. Graham is experienced in consumer credit matters, has litigated a variety of bank related disputes and is a specialist costs advocate. He regularly advises on risk and liability in privacy law issues and corporate governance e.g. implications for businesses of the new Bribery Act in the UK including probity issues. His international work has included a recent two month in-house assignment to a solicitor client in Kuwait City (worked together since 2007) assisting on energy related joint ventures, franchising agreements, hotel brand licensing, oil and gas related contracts and international arbitrations. Graham has background energy experience from Texaco, Saudi Aramco and Saudi Arabian basic industries. He is a current member of the Association of International Petroleum Negotiators with a special interest in IP/technology rights in energy transactions. He understands IP rights in an industrial/commercial context and can work up most collaborative scenarios from NDA through to Joint Venture/Participation agreement.
